Netlist Prevails in Reexamination of LRDIMM Patent at USPTO
USPTO Reexamination Appeal Closed With All 60 Claims Confirmed Valid
IRVINE, CA--(Aug 25, 2014) - Netlist, Inc. (NASDAQ: NLST), a leading provider of high performance memory solutions for the cloud computing and storage markets, announced today that the Patent Trial and Appeal Board ("PTAB") of the United States Patent and Trademark Office ("USPTO") issued a final decision in the reexamination of U.S. Pat. No. 7,532,537 ("'537 Patent") denying Inphi Corporation's request for a rehearing. The '537 reexamination appeal in the USPTO is now closed.
With this action, the PTAB reaffirmed its earlier decision upholding the validity of all 60 claims in the '537 patent reexamination, dismissing every single validity challenge raised by Inphi. These claims are directed to fundamental concepts of load reduction and rank multiplication which are integral to the design of LRDIMMs at DDR3 and DDR4.
Inphi's only opportunity to challenge the PTAB's final decision is an appeal to the U.S. Court of Appeals for the Federal Circuit, which it must file by mid-October 2014. The '537 Patent is also the subject of litigation between Netlist and Inphi in the Central District of California, which has been stayed pending the outcome of the reexamination, including any subsequent appeals.
"This significant victory in the USPTO represents a culmination of over four years of focused effort and validates our position as the innovation leader in high performance server memory," said C.K. Hong, President and CEO of Netlist. "The '537 is the only LRDIMM patent we are aware of to have survived reexamination and be confirmed by the PTAB. We are confident of prevailing at the Federal Circuit should Inphi decide to challenge the PTAB's ruling. We expect to achieve similar success in our other ongoing reexaminations and continue to aggressively pursue monetization opportunities in the fast growing LRDIMM market, as well as the hybrid memory storage market."
Netlist has steadily invested in and grown its IP portfolio, which now includes 51 issued or granted patents and more than 30 U.S. and foreign pending patent applications in the areas of high performance memory and hybrid memory technologies.
